These Terms and Conditions of Sale explain how products may be ordered from Paul Darlington Ltd trading as Darlington Opticians through our website. By placing an order, you agree to these terms. Nothing in these terms affects your statutory rights as a consumer under UK law.

Ordering
Adding products to your basket does not create a contract. Your order is an offer to buy the selected products. A contract is formed only when we confirm acceptance of your order. You will have the opportunity to review and correct your order before completing checkout. We may refuse or cancel an order where products are unavailable, payment cannot be authorised, eligibility checks are not satisfied, or there is an obvious pricing or description error.

Contact lenses are supplied only where it is lawful and appropriate to do so, and we may require confirmation of a valid contact lens specification or other information before dispatch.

Products are subject to availability and we may withdraw or change products at any time.
Prices and payment
Prices are shown in pounds sterling and include VAT where applicable. Delivery charges and any other applicable costs will be shown before you place your order. Payment must be made during checkout using the payment methods offered on the website. If an obvious pricing error is identified, we will contact you before accepting or processing the order.
Delivery
We deliver to UK mainland addresses unless stated otherwise at checkout. Estimated delivery times are provided for guidance only. We will aim to deliver your order within 30 days unless a different delivery period is agreed. Risk in the products passes to you when the products are delivered to the address provided.
Cancellation rights
If you are a consumer buying online, you usually have the right to cancel your order within 14 days after the day you receive the goods. To cancel, contact us using the details above and clearly state that you wish to cancel. The right to cancel may not apply to certain products, including sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed, personalised or custom-made products, or other products excluded by law.

You must take reasonable care of products while they are in your possession.

You are responsible for return postage unless the product is faulty, not as described, or we agree otherwise.
Returns and refunds
If you cancel within the applicable cancellation period, you must return the products to us without undue delay and no later than 14 days after telling us you wish to cancel. We will refund eligible payments without undue delay and no later than 14 days after we receive the returned goods, or after you provide evidence that you have sent them back. Refunds will normally be made using the same payment method used for the original purchase. We may reduce a refund where products have been handled more than necessary to establish their nature, characteristics and functioning.
Faulty or incorrect products
If a product is faulty, damaged, not as described, or the wrong item has been supplied, please contact us as soon as possible. Your legal rights under the Consumer Rights Act 2015 are not affected.
Liability
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any rights that cannot be excluded by law. Subject to this, we are not responsible for losses that were not reasonably foreseeable, or for business losses where products are bought for personal consumer use.

Governing law
These terms are governed by the laws of England and Wales. If you are a consumer, you may also have rights to bring a claim in the courts of the part of the United Kingdom where you live.
